3D Practice – Terms of Service

Welcome to 3D Practice! By accessing or using our SaaS product (“Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

1. Acceptance of Terms

By signing up for and/or using our Service, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

2. Subscription and Billing

Subscription Plans: The Service is provided on a subscription basis, with options for monthly or annual plans.
Fees: Subscription fees (“Fees”) are due and payable in advance. Fees are non-refundable except as required by law.
Billing Authorization: By providing a payment method, you authorize us to charge the Fees applicable to your chosen subscription plan.
Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless canceled prior to renewal.
Refunds & Chargebacks: All payments are non-refundable. Chargebacks without contacting us first may result in account suspension.

3. No Long-Term Commitment

You may cancel your subscription at any time. Access continues until the end of the billing cycle.

4. User Responsibilities

Account Security: You are responsible for the confidentiality of account credentials.
Acceptable Use: You may not misuse, reverse engineer, scrape, or disrupt the Service.

5. Modifications to the Service and Pricing

We may modify, update, or discontinue the Service at any time. Pricing changes apply to future billing cycles.

6. Termination

Termination by You: You may terminate at any time.
Termination by Us: We may suspend or terminate for violations. Fees already paid are non-refundable.
Data Retention: Data may be retained for up to 30 days after termination before deletion.

7. Intellectual Property

All content, software, animations, graphics, and materials are owned by 3D Practice or licensors.

8. Data Ownership, Processing & Privacy

You own your business data. 3D Practice owns all platform content including animations, videos, and templates. You may request data export while your account is active.

9. HIPAA, Medical Use & Healthcare Compliance

3D Practice is not a HIPAA Business Associate and does not provide a BAA. PHI must not be uploaded.
No Medical Advice: The Service is for educational purposes only.

10. Limitation of Liability

Our total liability is limited to the amount you paid in the last 12 months. We are not liable for indirect damages.

11. Indemnification

You agree to indemnify and hold harmless 3D Practice from claims arising from misuse, legal violations, or content you upload.

12. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind.

13. AI Functionality Disclaimer

AI output may be incomplete or inaccurate. You must review all AI-generated content before using it with patients.

14. Governing Law & Venue

These Terms are governed by Florida law. Legal actions must be filed in Tampa, Florida.

15. Export Controls & International Use

You must comply with U.S. export laws.

16. Changes to These Terms

We may revise Terms at any time. Continued use means acceptance.
